Ok so due to the heavy winds we had a huge tree branch fell onto the hood of my car WHILE i was driving. My insurance has a $500 deductible and im wondering if my township has to pay that. a little info, the branches spanned the width of the street, there is a brace line wrapped around the tree connected to a power line. the tree was located in someones fenced in yard (mind you these are connected townhouse like things located in a small township. any advice?

    The tree fell over due to mother nature, there is no way out of the deductible. But next time before a big storm change your deductible to $250, just incase.

    The town is not responsible, but the homeowner may be. Consult your insurance agent about the legal liability here.

    No Insurance Company or Home Owner or Town is responsible. It is what is called “An Act Of God” and they will not be liable. The only way you could ever have any chance of collecting would be if the tree were Dead and residents had reported it to the City as being Dead and a Hazard and they had not removed it, then they could be held partially liable, but that is the only way.

    No.
    You will have to shell out the $500 UNLESS you can prove the town (or owner of the tree) was somehow negligent, such as being warned the tree was rotten and was a proven menace prior to the winds that blew it over.
